Terms and Conditions of Sale – Boat Serenity

1. General Information

1.1. Company Identity

Boat Serenity is a company registered in Saint-Martin, operating private maritime excursions with a skipper aboard a commercial pleasure vessel.

1.2. Acceptance of the Terms

Any booking implies full acceptance of these Terms and Conditions, the onboard safety policy, and the passenger regulations. This acceptance is formalized at the time of online booking or through written confirmation sent to the client.

2. Booking, Payment, and Cancellation

2.1 Booking & Payment

Reservations are made online or directly with Boat Serenity.

  • The service is confirmed after full payment of the total amount, made by credit card (Visa, Mastercard) via a secure payment link.
  • A written confirmation (email or message) is sent to the client, serving as the service contract.
  • The passenger register (full identity) must be completed before boarding.
  • Default boarding : Hommage Hotel & Residences 4* Marina, Baie Nettlé Other locations possible on request, with additional charge.
  • Passengers must arrive15 minutes before the scheduled departure time.
  • All prices are quoted including VAT, excluding mandatory local taxes.
  • For certain destinations, mandatory local taxes (e.g., Anguilla entry tax of €35 per person) apply. These taxes are not included in the listed price and must be paid in cash directly to the crew on the day of the excursion.
  • Passport is required for certain destinations (e.g., Anguilla) and must be provided at the time of booking and presented on the day of the excursion.

By confirming the reservation, the client acknowledges having read the excursion description, the usual weather conditions, and any potential usage limitations.

2.2 Modification & Cancellation

Cancellation or modification by the customer :

Boat Serenity offers flexible conditions while ensuring optimal organization of its private trips.

  • More than 72 hours before departure : 70% refund of the paid amount OR possibility to reschedule within 6 months of the original date.
  • Between 24 and 72 hours before departure : no refund possible, but rescheduling may be offered subject to availability.
  • Less than 24 hours before departure or no-show : no refund and no rescheduling possible.

Any modification (date, time, options, or number of participants) must be submitted in writing at least 24 hours before departure and remains subject to the availability of the boat and crew.

Boat Serenity reserves the right to retain any amounts already received to cover preparation, booking, and boat unavailability costs.

Cancellation or modification by Boat Serenity :

Safety and the quality of the experience take priority. Boat Serenity may need to modify or cancel a trip in the following cases :

  • Adverse weather conditions compromising safety (strong winds, high waves, storms, dangerous sea warnings).
  • Technical failure, administrative restrictions, or any other force majeure event.

In these situations :

  • Rescheduling the trip will be offered as a priority.
  • If rescheduling is not possible, le a full refund of amounts paid will be issued.

A passing rain shower or cloudy sky does not constitute a valid reason for cancellation. Boat Serenity cannot be held responsible for additional expenses incurred by the client (accommodation, transport, etc.) in the event of cancellation due to force majeure.

3. Safety & Navigation

3.1. Navigation Conditions

  • Theskipper is the sole authority on board and responsible for all decisions related to navigation and safety
  • Life jackets may be required at any time depending on sea conditions.
  • Life jackets are available for all ages.
  • The skipper may modify the planned itinerary for reasons of safety, weather, or maritime traffic, without giving rise to any compensation.

Boat Serenity cannot be held responsible for the consequences of a safety decision made by the skipper in the interest of the passengers.

3.2. Declaration of Swimming Ability

All passengers must inform the skipper if they cannot swim or feel uncomfortable in the water before departure.

3.3. Onboard Safety Policy

  • Compliance with skipper instructions.
  • Wearing a safety or water sports life jacket may be required.
  • Dangerous behavior, intoxication, or the use of illicit substances is strictly prohibited.
  • Boarding may be refused or the excursion interrupted without refund in case of misconduct.
  • Please inform us of any specific situation (reduced mobility, pregnancy, allergies, etc.) at the time of booking.

Boat Serenity cannot be held responsible for any incident resulting from failure to follow safety instructions.

4. Onboard Life & Activities

4.1. Included Activities

  • Snorkeling, paddleboard, floating mat..
  • Wearing a life jacket is required depending on the activity.
  • Water activities are free and unsupervised: each participant is responsible for themselves.
  • Children under 12 must remain under the mandatory supervision of an adult.
  • Fishing is strictly prohibited on board.

Some activities may be suspended depending on weather conditions or local regulations.

4.2. Open bar & services

  • Included : sodas, beers, wines, juices for children, water, cocktails
  • Champagne includedfor the Sunset package

4.3. Options on request (booking 24h in advance)

  • Towed buoy – 30 min for 1 to 2 people
  • Waydoo – motorized snorkeling
  • Flyboard – thrill experience
  • Souvenir pack – photos & vidéos (drone + GoPro)
  • Restaurant drop-off
  • Champagne, spirits, or specific drinks : on request
  • Additional hour of navigation

5. Conduct & Liability

  • Respectful behavior is required toward the skipper, equipment, and other passengers.
  • In case of voluntary or negligent damage repair costs will be charged to the client.
  • Smoking is prohibited unless approved by the skipper. Vaping is allowed.
  • No animals are allowed on board.
  • Boarding may be refused to any person under the influence of alcohol or drugs.

6. Legal Framework & Data

6.1. Insurance & Liability

  • Boat Serenity is insured for the maritime transport of passengers in accordance with applicable regulations.
  • No responsibility is assumed for loss or theft of personal belongings.
  • In case of client delay, the return time will not be adjusted.
  • Any incident must be reported immediately to the skipper so that a report can be made for the insurance claim.

6.2. Personal Data

  • The information collected is treated confidentially and is never shared with third parties without prior consent.
  • In accordance with the General Data Protection Regulation (EU 2016/679), each client has the right to access, correct, delete, and object to the processing of their data.

6.3. Applicable Law & Disputes

  • These terms and conditions are governed by French law applicable in Saint-Martin.
  • In case of a dispute, the parties agree to seek an amicable solution before taking any legal action.
  • Failing that, disputes will be brought before the competent courts of Saint-Martin. .

7. Image Rights

Unless expressly objected to in writing at the time of booking, the client authorizes Boat Serenity to use photos and videos taken during the excursion for promotional purposes (website, social media, brochures).
